Why Hire A Media Workers’ Comp Attorney

If you have sustained a workplace injury, no matter how minor it seems initially, you need the help of a seasoned workers’ compensation attorney. Pennsylvania workers’ compensation laws are very complex statutes and these laws provide benefit for workers who suffer an injury or develop an occupational disease or impairment in the course of employment. Over the course of my legal career I have handled many workers comp claims, both state fund and self-insured employer cases, for workers all over the state and country, with just about every injury imaginable. Other lawyers either handle just a few cases per year, or sign up a lot of clients and leave them in the care of their paralegals. By retaining my services you will have the benefit of the training, experience and dedication of an attorney from your first visit to the conclusion of your case. You will meet, talk and plan with us, we will get to know you, and we will strive to maximize your benefits and reduce your frustration at every step of the process. I am very unique in this regard.

In the vast majority of claims, the act provides the sole remedies and governs the procedures to adjudicate a work place industrial injury or occupational disease.

Occupational diseases do not occur on one day. These, generally, develop over a long period of time due to the specific physical nature of employment. We often see people with carpal tunnel, degenerative changes in the back, hearing loss, etc… as a result of specific employment conditions.

Whether you have an industrial injury or an occupational disease, you must have a physical injury to be able to open a claim for benefits under Washington law. However, if you are diagnosed with psychiatric conditions (depression, anxiety, PTSD, etc…) as a result of your industrial injury, it may be accepted on your claim. If you are having trouble getting a psychiatric condition allowed on your claim, please contact Delaware County workers’ comp attorney James V. Monaghan to see how I can help.

You have limited time to file a claim after your injury or occupational disease. With an industrial injury, you only have one year to file a claim before it will be time-barred.

Under Pennsylvania wokrs comp statute of limitations for claims for occupational disease or infection to be valid and compensable, they must be filed within two years following the date the worker had written notice from a physician or a licensed advanced registered nurse practitioner: (a) Of the existence of his or her occupational disease, and (b) that a claim for disability benefits may be filed. The notice shall also contain a statement that the worker has two years from the date of the notice to file a claim. The physician or licensed advanced registered nurse practitioner shall file the notice with the department. The department shall send a copy to the worker and to the self-insurer if the worker’s employer is self-insured. However, a claim is valid if it is filed within two years from the date of death of the worker suffering from an occupational disease.

Typical benefits available under a Pennsylvania worker’s compensation claim include:

  • Medical Benefits
  • Wage Replacement (time loss, loss of earning power)
  • Vocational Retraining
  • Permanent Partial Disability
  • Permanent Total Disability (Pension)
  • Structured Settlement

There are rules regarding which of these will be approved by the Department of Labor & Industries or you Self-Insured Employer. If you are denied medical treatment, give my Media workers compensation law office a call as I may be able to help.

Medical Benefits – These can include:

  • Surgery
  • Doctor’s appointments
  • Physical therapy
  • Massage therapy
  • Prescription medications
  • Rehabilitation services

In addition, you have the right to choose your own doctor to treat you for your injuries. Your employer cannot make you see a doctor that they choose for treatment purposes. However, they may request an IME (Independent Medical Examination) to have a doctor forensically exam you to base an opinion about treatment, ability to work and disability. If you have a pending IME, it’s probably a good time to talk to a lawyer about your claim.

Pennsylvania Work Comp Statute Of Limitations

Under current PA laws an injured worker has 24 months from the date of injury or date of death to file a workers’ compensation lawsuit. Filing a work injury claim is very complicated and should only be done by a Media Pennsylvania workers’ compensation lawyer.
